Flagler nursing home death: Suspect attacked resident because he was 'mad'

On Thursday, new court documents were released in the case of a nursing home resident beaten to death in Palm Coast.

It happened early Wednesday morning at Gold Choice Assisted Living & Memory Care on North Old Kings Road in Palm Coast.

Cliff Mody has been charged with second-degree murder.

According to an affidavit, Mody told Flagler County officials that the 77-year-old victim entered his room and laid down on his bed.

He stated he told her to leave but she didn't, so he struck her in the head.

Mody stated the woman still did not leave his room so he decided to "eye gauge" her with his fingers and continued to hit her.

Mody said the woman asked why he was hurting her and he told her because she wouldn't leave his room.

According to the affidavit, Mody then put her in a chokehold and "put as much pressure as he could."

He reportedly admitted that he understood this would possibly kill her.

After the victim stopped breathing, Mody let her go and called staff to his room. When they asked why he attacked her, he replied that he was "mad."

Staff members say the victim had a diminished mental capacity and would routinely enter the rooms of other residents and try to lay in bed with them.

A medical examiner concluded she died from manual strangulation.

Cliff Mody had to use a walker to get up in front of the judge Thursday, just one day after he allegedly killed a woman at a Flagler County facility. The judge asked him about his income.

"Mr. Mody, the disability is the only income you have sir?" the judge asked.

"I don’t have none," Mody said.

Mody is being kept in jail for now. The Flagler County Sheriff’s Office arrested the 72-year-old Wednesday night after an all-day investigation.

WESH 2 has learned he’d been living at the Gold Choice Assisted Living & Memory Care on North Old Kings Road in Palm Coast.

The sheriff’s office says just before 2 a.m. on Wednesday, he attacked a 77-year-old woman. Staff members making their rounds found her with obvious facial injuries, and no pulse, on his bed.

A 911 call detailed the confusion and terror after she was found:

"I said 'what happened?' He said, 'she wandered in my room, she wandered in my room, she wandered in my room.' And I said, 'what did you do? I see her lip’s busted.' What else did you do to her? And he goes 'I choked her.'"

“Our thoughts and prayers go out to the families involved, and we worked hard to make sure the suspect is held accountable for his actions," Sheriff Rick Staly said in a statement.

A staff member also told 911 that Mody had been in the assisted living side but was moved to the memory care side after attacking another resident.

WESH 2 has left messages with the owner of the facility but hasn't heard back.

Mody is charged with second-degree murder.

According to inspection records for the company, the Palm Coast location has undergone two inspections since it opened with no complaints or citations.

However, the Ormond Beach location has had at least 19 complaints and eight deficiencies.

Records show the Deltona facility has had six complaints and three deficiencies.

Among the most frequent citations - were failing to provide medication in a timely manner, and failing to assist with self-administration of medication.

Records also show that Gold Choice has consistently corrected any problems found by state inspectors.
